FIXED PRICE REPAIR TERMS AND CONDITIONS
- APPLICATION OF these conditions
a. These terms and conditions (the “Terms”) apply to the provision of fixed price repair services (“Services”) by Electrolux plc (“Electrolux”, “us” or “we”). Electrolux plc is registered in England and Wales under company number 02331516 with its registered office at Addington Way, Luton, LU4 9QQ, Bedfordshire, England. The VAT number for Electrolux plc is GB 196 2439 34.
b. You accept and agree to be bound by the Terms. Please read these Terms carefully and make sure that you understand them, before ordering any Products or Products and Services and Services.
c. Electrolux reserves the right to amend the Terms at any time without notice. Such change however will have no effect on orders for services that were submitted prior to the amended Terms being posted on the Web Site.
d. For the terms of use regarding the use of www.electrolux.co.uk (“Website”) and privacy regulations (including Electrolux’s privacy policy), please refer to www.electrolux.co.uk.
2. PRICES
a. The prices of the Services will be as quoted on the Website from time to time.
b. The price of the Services includes VAT (where applicable) at the rate chargeable in the UK for the time being.
3. CAN I CANCEL MY REPAIR?
a. If you contact us before 12:00pm on the day before your initial engineer visit you will receive a full refund.
b. If you contact after this point you will receive a full refund minus the original callout charge
4. WHAT IS INCLUDED IN A FIXED PRICE REPAIR?
a. The price of the Services includes the following:
i. repair of the reported fault/s, at the time of booking, for a single domestic appliance;
ii. Any additional faults that could not be identified at the time of booking;
iii. the costs of necessary labour and parts (up to a maximum of £500)
b. The following are not covered by this service:
i. Repairs following an insect or vermin infestation, unless an authorised pest control organisation certify that the appliance is safe to repair;
ii. where the engineer deems the appliance unsafe to repair, due to reasons including fire, flooding or an electrical malfunction.
iii. repair of any additional faults to the same appliance, not reported at the time of the initial booking, unless the appliance was not functioning therefore faults could not be identified;
iv. repair or replacement of any damage caused to the relevant product’s surrounding area or other personal items such as items of clothing, dishware or cutlery;
5. FIXED PRICE REPAIR GUARANTEE
a. The guarantee includes the following:
i. Services performed under a Fixed Price Repair will come with a 3 month guarantee from the date the appliance is repaired;
ii. Replacement parts are guaranteed for 12 months;
iii. This guarantee is in addition to your statutory rights and in addition to your rights set out at clauses 10 and 11 below;
b. The following are not covered by the Fixed Price Repair Guarantee:
i. any subsequent faults to the repaired item caused by neglect, misuse damage (deliberate or otherwise) or other third party causes (including insect and vermin infestation);
ii. A recurrence of the same fault as a consequence of improper installation or not following the manufacturers guidelines in regard to the placement of the appliance;
iii. replacement of missing parts or products due to loss or theft;
iv. consumable items (including built-in batteries, bulbs & filters);
v. cosmetic damage caused following the repair, where it does not affect the operation or safety of the product
vi. damage or breakdown due to flood, wind or other severe weather conditions;
vii.repair of damage or breakdown due to fire, unless caused by an electrical malfunction within the product;
viii. repairs carried out on appliances used in a commercial setting;
c. The guarantee is not extended following a repair to the same fault during the Fixed Price Repair Guarantee period;
6. HOW DO I CLAIM UNDER MY GUARANTEE?
a. Please call our customer services line on 03445 611 611;
b. If we cannot solve your problem over the phone we will send an engineer out to you.
7. WHAT IF MY APPLIANCE CANNOT BE REPAIRED?
a. If your appliance is unable to be repaired or is beyond economical repair, we will refund the price of the repair less the Call Out Fee of £80.00 (inc. VAT).
b. If your appliance has not been repaired, following attempt(s) to repair in no less than 14 days of our first visit, and you decide not to continue with the repair, we will refund the price of the repair less the Call Out Fee of £80.00 (inc. VAT).
c. In the above cases, you are entitled to a refund of the price of the repair less the Call Out Fee of £80.00 (inc. VAT). The offer of a replacement will include a discount of £75 (inc. VAT) in addition to your refund and any promotions at the time of purchase when purchased directly from us through our Contact Centre.
8. RIGHT TO REPAIR, REPLACEMENT OR REPEAT PERFORMANCE
a. While we will use reasonable endeavours to ensure that repairs are conducted with reasonable skill and care and in accordance with these Terms and any description of those services we have provided to you (“Contract”), there may be occasions where you the service you have received falls below that standard.
b. If you are a consumer, you have a legal right to request that we re-perform any Services in order to ensure that they conform to terms of the Contract between us and you.
c. To request that we repeat performance of any Services, you can call us on 03445 611 611.
d. The offer of a replacement can only be supplied within the UK mainland.
e. We will endeavour to provide a suitable alternative, if we no longer manufacture your product type we will propose alternatives, however we are unable to offer any additional discount in the event we are unable to supply a replacement.
f. For Zanussi, Electrolux and retailer exclusive brands, the replacement offered may not be the same as your original brand.
9. OUR LIABILITY IF YOU ARE A CONSUMER
a. If you are a consumer and we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it was an obvious consequence of our breach or if it was contemplated by you and us at the time we entered into the Contract.
b. We do not in any way exclude or limit our liability for:
i. death or personal injury caused by our negligence;
ii. fraud or fraudulent misrepresentation;
iii. any breach of the terms implied by law which cannot be excluded or restricted, including, but not limited to, your rights as a consumer as detailed in our Returns Policy; and
iv. defective products under the Consumer Protection Act 1987.
c. Except as stated in the Contract and to the extent permitted by law, we exclude all conditions, warranties or terms which might otherwise be implied by law.
d. Subject to clause 11.b above, our total liability to you in respect of any loss arising under or in connection with the Contract (howsoever arising) shall in no circumstances exceed 100% of the charges paid or payable for the Services.
